On 1 July 2010 the Freedom of Information Act 1989 (FOI Act) was repealed and replaced with the Government Information (Public Access) Act 2009 (NSW) (GIPA Act). For further information on the GIPA Act and the new Right to Information laws click here
SWAHS has transition arrangements in place and will continue to comply the provisions of the FOI Act for applications made under the FOI Act prior to 1 July 2010, for a certain period of time. In these cases, the FOI Act applies regardless of whether those applications have been determined or not by the time the GIPA Act is effective.
Applications for access to government information made after the commencement of the GIPA Act on 1 July 2010 will be dealt with under the GIPA Act. The GIPA Act provides that an application for access to information made within 12 months after the repeal of the FOI Act is deemed to have been made under the GIPA Act, even if the application states that it is made under the FOI Act.
